Virginia Fatal Fall Wrongful Death Lawsuit Filed

The family of an elderly man who died after multiple falls in a Virginia nursing home in Williamsburg is suing the facility for nearly $27 million.
The wrongful death lawsuit was filed last week in James City County Circuit Court by relatives of Roper Houston, 70, who say negligence at the Ruxton Health nursing home led to his death in September 2007. The family alleges that staff members ignored numerous warnings and safety precautions and allowed Houston to fall 14 times. The final nursing home fall, according to the lawsuit, resulted in a subdermal hematoma, or bleeding in the outer layer of the brain. Nursing home staff saw blood in Houston’s urine after the fall and assumed it was an infection and took him to the hospital two days after the fall, just before his death.
The family is suing the home and its former administrator for $26.85 million. The nursing home was sold in January to Envoy Health Care Services.
